The two Kansases, and why it matters immediately

Search Kansas investment property and you land in Johnson County. Overland Park, Lenexa, Shawnee, Olathe. Excellent schools, strong incomes, the part of Kansas that gets written about. It is also, on the numbers, the weakest DSCR market in the state.

A 4.2% gross yield rarely clears a 1.0 DSCR ratio on a standard down payment once taxes and insurance are inside the payment. A 7.8% gross yield usually does. That is the whole reason this page leads with the split rather than a welcome paragraph. What is a DSCR loan and how does it work in Kansas?

DSCR stands for Debt Service Coverage Ratio. Divide the property's gross monthly rent by its full monthly payment, principal, interest, taxes, insurance and any dues, together the full PITIA, and that quotient is your approval. At 1.0 the rent exactly covers the payment; above it the property carries itself. Your W-2s, returns and personal debt-to-income never enter the file, and it closes in an LLC on 1-4 unit rental property from the first deal. Full mechanics: the Kansas DSCR guide.

Kansas hands you the shortest clock in our network

KSA §58-2564(b) lets a landlord terminate the rental agreement if rent is unpaid when due and the tenant fails to pay within three days after written notice of nonpayment and the landlord's intention to terminate.

The statute is unusually precise about how those three days run: the period "shall be computed as three consecutive 24-hour periods," and when the notice is served on the tenant, on a person over 12 residing on the premises, or posted conspicuously on the premises, the three days commence at the time of delivery or posting. Mailing adds two days.

Compare the other states in our lending footprint: Oklahoma five days, Wisconsin five, Kentucky seven in adopting jurisdictions, Pennsylvania ten by default. Kansas is the shortest, and the 24-hour computation means you are not waiting out a business-day convention. For a buy-and-hold investor that compresses the most expensive part of a default. The Kansas tax advantage most investors never hear about

Kansas classifies real property in its constitution, and the residential subclass reads: "Real property used for residential purposes including multi-family residential real property and real property necessary to accommodate a residential community of mobile or manufactured homes ... 11 1/2%."

Read what that does. In Kansas a duplex, a fourplex and a twelve-unit building are all assessed at 11 1/2% of value, the same subclass as a single-family house, rather than at the 25% commercial and industrial rate. Several states do the opposite and flip a building into a commercial class once it passes a unit threshold, which lands directly in the tax line inside your PITIA. Wisconsin, for instance, puts apartment houses of four or more units in its Commercial class.

A Kansas vacant lot, by contrast, is assessed at 12%, higher than the improved residential rate, so this state penalizes land-banking relative to holding a rental. Full detail: Kansas rental property taxes.

Rent control is preempted, and so is the workaround

KSA §12-16,120(a) bars every Kansas political subdivision, county, municipality and township alike, from enacting, maintaining or enforcing any ordinance or resolution that would have the effect of controlling rent or purchase price on privately owned residential or commercial property.

The part that makes Kansas unusual is subsection (d). No political subdivision may require an owner to accept rent controls as a condition for consideration or approval of a building permit, a plat, or a zoning request. That closes the inclusionary-zoning route that other states use to reach rent restriction without calling it rent control. Detail: rent control preempted statewide.

Those ratios rarely clear a 1.0 DSCR on a standard down payment. Johnson County is a strong appreciation and quality-of-life market; if your objective is a ratio, the same capital works far harder in Wyandotte County or Topeka.
